All circuit divisions operate under Local Rule 33.1 for the filing of routine civil motions. Under this rule, attorneys may set routine civil motions for hearing, upon proper notice, at 9:00 a.m. on Tuesdays, Wednesdays, and Thursdays, subject to the Court’s availability and other scheduled court business. A routine motion is defined as one that can be heard in five (5) minutes or less. If a motion will require more than five (5) minutes, counsel must contact the division clerk to obtain a hearing date.

Judges who primarily handle criminal dockets will make reasonable efforts to hear routine civil motions on the date set by the attorney. However, their availability is more limited due to other scheduled court obligations. As a result, there may be a longer wait before a routine motion set in a circuit criminal division can be heard.

In all divisions, counsel may coordinate hearing dates and scheduling matters with the division clerk. Contact information for each division’s staff is available at this link.

If a case is assigned to a judge outside the judge’s primary case assignment, it is recommended that counsel contact the division clerk to address scheduling matters

Thank you to outgoing commissioners, Neil Chanter and Debbie Dodge, for their considerable service.

Presiding Judge Jerry Harmison has notified the SMBA that an attorney has had their bypass privilege rescinded after entering the courthouse with a prohibited item.  The list of prohibited items is posted at the entrance.  The Court en Banc expects all members of the Missouri Bar to take note of the posted
list and comply with the conditions of Administrative Order 2025-AO12.  Future violations could result in the court rescinding the bypass privilege not just for the individual doing so, but for the entire bar.

Clerk Announces Regular Election for Southern District

Attorney-Member of The Appellate Judicial Commission

SPRINGFIELD, Mo. – Pursuant to Supreme Court of Missouri Rule 10, the clerk of the Missouri Court of Appeals, Southern District, will conduct an election on November 5, 2025, to elect a member of The Missouri Bar from the Southern District to fill a six-year term on The Appellate Judicial Commission. The election – in which only members of The Missouri Bar residing in the Southern District may participate – is for the term beginning January 1, 2026, after the expiration of the term of current member Neil Chanter.

The Appellate Judicial Commission nominates candidates for judicial vacancies on the Supreme Court of Missouri and Missouri Court of Appeals.

Attorneys who wish to be candidates for election to The Appellate Judicial Commission must submit a nominating petition and biographical sketch (300 words maximum, no images) to Craig Street, Clerk of the Missouri Court of Appeals, Southern District, by October 6, 2025. The petition must be signed by at least 20 members of The Missouri Bar in good standing who reside in the Southern District, at least 10 of whom do not reside in the same judicial circuit as the candidate. An approved nominating petition form is available at https://www.courts.mo.gov/file.jsp?id=101914.
